bulletArizona Contractors Licensing Exemption is modified through HB 2585 "Handyman Exemption" Bill. Arizona Law requires that you must be licensed if you perform $1,000 work on a project, including labor, materials and all other items, but excluding any electrical fixture or appliance, that was designed by the manufacture, that is unaltered, unchanged or unmodified by any person, that can be plugged into a common electrical outlet utilizing a two pronged or a three pronged electrical connector and that does not use any other form of energy, including natural gas, propane or other petroleum or gaseous fuel, to operate or is attached by a nail, screw or other fastening device to the frame of foundation of any residential structure.

 

bulletBill is signed by The Governor for Licensing Exemption of Herbicide Application. SB 1221 exempts landscapers and others who use commonly available herbicides to kill weeds from licensing requirements imposed on the commercial pest-control industry. SB 1221 exempts persons using application equipment with a capacity of up to eight gallons of mixed liquid non-restricted use herbicide and 25 pounds of non-liquid, non-restricted use herbicide for the purpose of weed control from the Structural Pest Control Commission's licensing requirements. Though exempt, such persons would still be required to inform customers of the common name or trade name of the product they used and the date of application. They must also retain records. SB 1221 does not exempt persons using sterilants or who offer weed control as their primary service from SPCC's licensing requirements. It also provides that exempt persons may still be subject to SPCC penalty of they do not apply products according to label directions or provide consumers with the required information.

The 47th Arizona Legislative Session had the following bills introduced that affected the landscaping industry.

SB 1322 contractors; indemnity agreements.  The purpose of the bill was to allocate the cost of negligence in the construction industry fairly by ensuring that negligent parties bear the cost according to their degree of fault.

HB 2516 was adopted regarding the Qualifying Party for Structural Pest Control.  It reads joint responsibility, business licensee, qualifying party or applicator; rules; rule making exemption.  A qualifying party or applicator may be held jointly responsible for the acts or omissions of another person who is under the supervision of the business licensee, qualifying party or applicator if the supervising licensee fails to properly train, equip or supervise the other person or fails to maintain records of proper training, equipping or supervising.

HB 2329 Water use standards; landscaping. Cities and towns shall adopt and enforce low water use standards for landscaping for all new subdivisions, and for condominiums, cooperatives and trailer parks with 20 or more units, that are established after the effective date of this section.

SB 1305 Persons not required to be licensed: penalties. Otherwise known as the handyman bill, this legislature was introduced to raise the limit of license requirements from $750 including materials to $1,500 and excluding materials. 

H-2B VISA Save Our Small and Seasonal Businesses Act of 2005.  This act requires the U.S. Citizenship & Immigration Services (USCIS) to accept additional petitions for H-2B workers.  What is H-2B visa?  The H-2B working visa is a nonimmigrant visa which allows foreign nationals to enter into the U.S. temporarily and engage in nonagricultural employment which is seasonal, intermittent, a peak load need, or a one-time occurrence.

In Spring of 2002, a Cap and Trade Oversight Committee (CTOC) was established to help determine the feasibility of an emissions cap and trade program to improve visibility in the Greater Phoenix Area.  The CTOC determined that the existing data for off-road equipment was in need of improvement.  The AZ Dept of Environment Quality (ADEQ) teamed up with the CTOC to propose off-road emissions inventory for the commercial lawn and garden equipment sector.

In 2000:  New legislation was introduced in the Arizona Legislature to prohibit the use of gasoline and diesel equipment to blow landscape and garden debris, beginning January 1, 2001.
